High Court overturns woman’s life sentence in double murder case
The Peshawar High Court has reversed the life sentence of a woman convicted of killing a mother and her young son. The court has ordered a mental state examination for the appellant and sent the case back to the trial court. Both the prosecution and defense will have an opportunity to present evidence and cross-examine witnesses. The trial court will then decide if the appellant is fit to stand trial.
The High Court’s judgment will be circulated to all district courts for guidance and compliance. The appellant was initially convicted in December 2022 but claimed mental illness, which was admitted by the complainant. However, the trial court did not refer her for a medical examination, in violation of legal procedures.
