A court in Dadu on Wednesday (April 8) reserved its verdict on an application filed by former MNA Ali Wazir seeking his discharge in a second FIR registered by Dadu police. The FIR was lodged following his re-arrest from Sukkur jail on March 16, and his counsel has contended it is based on trumped-up charges.
After his re-arrest, two allegedly fabricated FIRs were registered against Wazir: FIR No. 93/2026 at Police Station A-Section Dadu and FIR No. 40/2026 at Police Station B-Section Dadu. His counsel, Imdad Hyder Solangi, told Voicepk that a third FIR has since surfaced — registered by Jamshoro police on the night of March 19 — whose charges follow the same pattern as the two preceding cases. All three FIRs allege that a group acting on Wazir’s instructions blocked a road, carried PTM flags and weapons, chanted slogans against the state and the Pakistan Army, and opened fire on police before fleeing. Wazir’s legal team has termed the FIRs “false, bogus, and fabricated.”
Following his re-arrest, Wazir was produced before Ameer Ali Mahesar, In-charge Special Judge of the Anti-Terrorism Court (ATC) Naushehro Feroze, who declined the police’s remand request and remanded him to judicial custody in connection with the first FIR, to be taken to Dadu jail.
On Wednesday, proceedings in the second FIR — No. 40/2026 registered at B-Section Dadu — were scheduled before Civil Judge Dadu, Qambar Ali Jamali. Wazir’s counsel, Solangi, argued an application under Section 63 of the Code of Criminal Procedure (CrPC) seeking the accused’s discharge. After hearing arguments, the magistrate reserved the order and fixed April 13 for announcement of the decision.
Solangi also drew the court’s attention to a procedural lapse, noting that jail authorities had failed to produce Wazir before the court at the two previous hearings — a violation, he argued, of procedural law and Article 10-A of the Constitution of Pakistan, which guarantees the right to a fair trial. Taking serious note of the matter, the court directed the In-charge of District Jail Dadu to ensure Wazir’s production before the court on April 13 without fail. Solangi expressed hope that the second FIR would be dismissed and that Wazir would be discharged at the next hearing.
On Tuesday, Solangi and Wazir’s legal team had appeared before Civil Judge and Judicial Magistrate Jamshoro, Riaz Rasool Memon, for proceedings related to the third FIR. The matter was adjourned until April 10.
Separately, a constitutional bench of the Sindh High Court’s Hyderabad Circuit Court — comprising Justice Adnan Iqbal Chaudhry and Justice Riazat Ali Sahar — has taken up a constitutional petition (No. D-607/2026) filed by Wazir challenging the two Dadu FIRs. The bench has issued notices to senior provincial government and police officials, directing all respondents to submit their replies before the next hearing, fixed for April 22.
