ISLAMABAD:
The District and Sessions Court of Islamabad has extended journalist Asad Ali Toor’s physical remand for another two days, handing him over to the Federal Investigation Agency (FIA) in connection with a case involving contempt of judges of the Supreme Court.
Toor appeared before Judicial Magistrate Muhammad Shabbir today.
Responding to the court’s decision, Toor’s lawyer, Imaan Mazari, expressed strong dissent, telling Voicepk that the order is fundamentally flawed and illegal.
Mazari pointed out precedents where the judiciary refrained from granting such remands in similar cases. She said that during another proceeding at the Islamabad High Court (IHC), the court identified significant flaws in the case and found the FIA’s justification for detaining Toor lacking. Consequently, the honorable court issued notices to the FIA and adjourned the case until the following day.
This development underscores the growing scrutiny surrounding Toor’s detention, emphasizing the necessity for a thorough examination of the legal basis for his continued confinement.
Asad Ali Toor was arrested on February 26, 2023 by the FIA as part of an investigation into allegations of running a malicious social media campaign against the state institutions.
On February 27, he was brought before the judicial magistrate, where he was granted a five-day physical remand.
Further, on March 3, the District and Sessions Court of Islamabad extended his physical remand.
In response to the accusations, Toor asserts that he is being victimised due to his stance against injustice and his outspoken criticism of alleged unlawful acts committed by judges. Toor and his lawyer contend that his arrest is an attempt to silence dissent and curb freedom of expression.
This narrative adds a layer of complexity to the case, raising questions about the motivations behind Toor’s arrest – whether it is a response to his journalistic practices or his critique of the judiciary. It underscores the importance of a thorough and impartial examination of the charges against him to determine the true nature of the case.
Journalist Matiullah Jan alleged that the FIA is acting as a tool of the state and is systematically targeting journalists who speak out against prevailing injustices. Jan said that the case against Asad Toor “lacks substance and is merely an attempt to intimidate and harass journalists critical of the state’s actions”.
By framing the FIA’s actions as politically motivated and lacking in evidence, Jan highlighted the broader issue of press freedom and the challenges faced by journalists in exercising their right to free speech without fear of reprisal. He expressed concerns about the erosion of democratic values and emphasized the need for an independent and transparent investigation into the allegations against Toor.
Saqib Bashir, a senior reporter with over a decade of experience covering legal proceedings, highlighted a significant discrepancy between the FIA’s notice to Toor and the actual FIR filed against him. “The FIA’s notice focused on allegations related to Toor running a social media campaign against Supreme Court judges. But, the FIR, which forms the basis for the charges against him, reportedly makes no mention of the campaign against the judges.”
This revelation raises concerns about the coherence and consistency of the accusation, suggesting a potential disparity between the initial notice and the formal charges brought against Toor.
Bashir’s perspective underlines the need for clarity in the legal proceedings and a thorough examination of the evidence to ensure a fair and just resolution to the case.
As the case unfolds, questions linger regarding the motivations behind Toor’s arrest and the validity of the charges against him.
